Terms of Service
1. These terms
These terms cover your use of the Fablarr Tech website and the services we provide. By using the site, you agree to them. If you do not agree, please do not use the site.
Project work is also governed by a proposal or statement of work (SOW). If the SOW conflicts with these terms, the SOW wins for that project.
2. Services and statements of work
We provide web design and development, mobile app development, SEO and GEO, AI automation, maintenance, and related digital work. The scope, deliverables, timeline, and fees for each project are set out in the SOW.
We may use trusted subcontractors. We describe the work we will do; we do not guarantee a specific ranking, traffic level, or AI citation.
3. Fees and payment
- Fees are quoted in GHS or USD and are payable on the schedule in the SOW.
- Third-party costs such as domains, hosting, payment processing, and API usage are separate unless the SOW says otherwise.
- If an invoice is overdue, we may pause work or suspend services after telling you.
- New work is quoted at the rates in effect when it starts.
4. Client responsibilities
You agree to provide accurate information, content, access, and feedback when needed, and to hold the rights to any material you give us. Delays in content or approvals can move the timeline.
5. Intellectual property
When the final invoice for a project is paid, you own the deliverables created for you. We keep ownership of pre-existing code, libraries, tools, and methods, and of third-party materials. We may use generic know-how on other projects.
Unless you ask us in writing not to, we may show the finished work in our portfolio.
6. Third-party services
Projects may rely on hosting, payment, email, analytics, AI, or other providers. Their terms and availability apply. We are not responsible for outages, price changes, or policy changes made by those providers.
7. Confidentiality
Each side will keep the other's confidential information private and use it only for the project. This does not cover information that is public, already known, or required to be disclosed by law.
8. Limitation of liability
To the extent permitted by law, our total liability for a project is limited to the fees paid for that project. We are not liable for indirect or consequential losses, lost profits, lost data, or failures of third-party services.
Nothing in these terms limits liability that cannot be limited by law.
9. Termination
Either side may end a project in writing. You pay for work completed and approved expenses up to that point. Terms that by their nature should survive, such as intellectual property, confidentiality, and liability, continue after the project ends.
10. Changes
We may update these terms. The date at the top of the page shows the latest version. Continued use of the site after a change means you accept the updated terms.
11. Governing law
These terms are governed by the laws of the Republic of Ghana. The courts of Ghana have jurisdiction. Before starting a formal claim, both sides will try to resolve the issue in good faith.
